    Abstract
    Rumah sakit membutuhkan suatu metode untuk mengidentifikasi penyakit seseorang, menggunakan rekam medis. Dokumen rekam medis yang berisi identitas juga informasi medis pasien, termasuk sebagai rahasia kedokteran yang wajib untuk dijaga kerahasiannya oleh dokter, rumah sakit, maupun tenaga medis lainnya. Namun, kerahasiaan rekam medis tidak bersifat mutlak sebagaimana dinormakan dalam Pasal 5 ayat (1) Permenkes Rahasia Kedokteran, informasi rekam medis dapat dibuka untuk kepentingan tertentu sesuai peraturan perundang-undangan. Salah satunya untuk kepentingan umum yaitu kejadian luar biasa/wabah penyakit menular. Pembukaan rahasia rekam medis pasien COVID-19 yang dilakukan oleh pemerintah dalam konferensi pers mengenai pasien COVID-19 pertama di Indonesia, membuat informasi pribadi dan identitas pasien COVID-19 diketahui oleh masyarakat, sehingga mengakibatkan hak keperdataan pasien dilanggar. Hal tersebut dikarenakan di dalam permenkes rahasia kedokteran, tidak diatur mengenai kriteria atau batasan dalam pembukaan rekam medis untuk kepentingan wabah penyakit menular, sehingga menimbulkan kekaburan norma yang berdampak pada hak keperdataan pasien COVID-19. Guna mengidentifikasi dan menganalisis permasalahan tersebut, peneliti menggunakan metode penelitian hukum normatif dengan pendekatan konseptual, untuk menganalisis perlindungan hak keperdataan pasien COVID-19 terhadap rahasia rekam medis. Hospitals need a method to identify a person's illness, using medical records. A medical record document containing the patient's identity as well as medical information, including as a medical secret that must be kept confidential by doctors, hospitals, and other medical personnel. However, the confidentiality of medical records is not absolute as is normed in Article 5 paragraph (1) of the Minister of Health for Medical Secrets, medical record information can be opened for certain purposes in accordance with statutory regulations. One of them is for the public interest, namely extraordinary events / outbreaks of infectious diseases. The government's disclosure of the confidentiality of the medical records of COVID-19 patients in the first press conference regarding COVID-19 patients in Indonesia, made the personal information and identity of COVID-19 patients known to the public, resulting in the violation of the patient's civil rights. This is because in the Minister of Health secret medicine, there are no regulated criteria or limitations in opening medical records for the benefit of infectious disease outbreaks, thus creating a blurring of norms that have an impact on the civil rights of COVID-19 patients. In order to identify and analyze these problems, the researchers used a normative legal research method with a conceptual approach, to analyze the protection of the civil rights of COVID-19 patients against confidential medical records.
