Persuasive Communication Strategies in Divorce Mediation at Pengadilan Agama Jember
Abstract
Persuasive language in divorce mediation is used to influence the parties involved to follow what the mediator wants. This study aims to reveal the types of strategies and persuasive techniques mediators use to avoid divorce. The method of this study is qualitative descriptive with the approach being critical qualitative through the persuasive-utterance analysis model. The data of this study is in the form of utterances by phrases, clauses, or sentences that contain elements of persuasion in divorce mediation collected from 6 mediations during December 2023 at Jember Religious Court. First, the collected data were selected and coded according to the strategies and techniques implemented in each persuasion strategy. Next, the data were analyzed based on the persuasive theories of Aristotle (2007). The result of the study showed three types of persuasion strategies: Logos, Ethos, and Pathos. (1) Logos was applied using the technique of showing the bad effect of divorce, cause and effect, imperative, anecdote, slogan, and the use of language styles such as metaphor, analogy, irony, and simile; (2) pathos was applied using religious/social values, build positive images, slogan, providing definition, and, repetition; and (3) ethos was applied by using the technique emotional appeals, repetition, personification, and use of imperative sentences.
