dc.description.abstractKebijakan hukum pidana saat ini (ius constitutum) mengatur para pihak yang dapat mengajukan peninjauan kembali terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap dalam perkara pidana ialah terpidana atau ahli warisnya sebagaimana diatur dalam norma Pasal 263 ayat (1) KUHAP. Pasal 263 ayat (1) KUHAP menentukan: “Terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap, kecuali putusan bebas atau lepas dari segala tuntutan hukum, terpidana atau ahli warisnya dapat mengajukan permintaan peninjauan kembali kepada Mahkamah Agung”. Akan tetapi hal tersebut dalam praktek, Mahkamah Agung RI menerima dan mengakui Jaksa Penuntut Umum sebagai salah satu pihak yang dapat mengajukan peninjauan kembali terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap dalam perkara pidan selain terpidana atau ahli warisnya. Hal ini terdapat dalam beberapa kasus yang telah diputus oleh Mahkamah Agung RI, seperti antara lain: kasus Muchtar Pakpahan yang diputus melalui putusan Peninjauan Kembali nomor 55 PK/Pid/1996, tanggal 25 Oktober 1996, kasus Ram Gulumal alias V. Ram atau yang dikenal dengan kasus The Gandhi Memorial School yang diputus melalui peninjauan kembali nomor 3 PK/Pid/2001, tanggal 2 Agustus 2001, kasus Soetiyawati alias Ahua Binti Kartaningsih yang diputus melalui putusan peninjauan kembali nomor 15 PK/Pid/2006, tanggal 19 Juni 2006, kasus Pollycarpus Budihari Priyanto yang diputus melalui putusan nomor 109 PK/Pid/2007, tanggal 25 Januari 2008, kasus Syahril Sabirin yang diputus melalui putusan peninjauan kembali nomor 07 PK/Pid.Sus/2009, tanggal 8 Juni 2009 maupun dalam kasus Joko Soegiarto Tjandra yang diputus melalui putusan nomor 12 PK/Pid.Sus/2009, tanggal 11 Juni 2009. Masalah kewenangan Jaksa Penuntut Umum melakukan peninjauan kembali terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap dalam perkara pidana harus segera dipertegas pengaturannya agar terjamin kepastian hukum di Indonesia dengan melakukan kebijakan hukum pidana untuk yang akan datang (ius constituendum). Permasalahan yang dibahas dalam penelitian ini adalah sebagai berikut: pertama; apakah Jaksa Penuntut Umum dapat dibenarkan untuk mengajukan upaya hukum peninjauan kembali dalam perkara pidana. Kedua; bagaimana penerapan upaya hukum peninjauan kembali oleh Jaksa Penuntut Umum dalam praktek peradilan pidana di Indonesia. Ketiga; bagaimana seyogyanya pengaturan upaya hukum peninjauan kembali bagi Jaksa Penuntut Umum dalam pembaharuan hukum acara pidana Indonesia (RUU KUHAP) dimasa yang akan dating. Lebih lanjut, penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan historis, pendekatan konseptual dan pendekatan kasus. Sumber bahan hukum yang digunakan, yaitu sumber bahan hukum primer dan sekunder dengan teknik pegumpulan data melalui studi kepustakaan dan studi peraturan perundang-undangan. Hasil penelitian ini menunjukan bahwa pertama, masalah Jaksa Penuntut Umum mengajukan permintaan peninjauan kembali terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap dalam perkara pidana merupakan penyimpangan dari hukum positif (KUHAP) dan tidak dapat dibenarkan karena Norma Pasal 263 ayat (1) KUHAP merupakan norma yang sudah jelas dan limitatif mengatur para pihak yang dapat mengajukan peninjauan kembali, yaitu terpidana atau ahli warisnya. Disamping itu juga, sejarah dan dibentuknya lembaga peninjauan kembali semata-mata ditujukan bagi terpidana untuk meminta pemeriksaan ulang atas perkaranya. Sebagai contoh kasus Sengkon dan Karta. Kedua, penerapan upaya hukum peninjauan kembali oleh Jaksa Penuntut Umum dalam praktek di Indonesia, Mahkamah Agung tidak konsisten karena disatu sisi mengabulkan permintaan peninjauan kembali oleh Jaksa Penuntut Umum dan disisi lain menolak perkara peninjauan kembali Jaksa Penuntut Umum, seperti antara lain kasus H. Mulyar bin Samsi dari Muara Tuweh yang telah diputus dengan Putusan MA RI Nomor 84 PK/Pid/2006. Mahkamah Agung RI menolak permintaan peninjauan kembali dari Jaksa Penuntut Umum dengan alasan karena Pasal 263 ayat (1) KUHAP telah mengatur secara tegas dan limitatif yang dapat mengajukan peninjauan kembali ialah terpidana atau ahli warisnya (alasan undang-undang), Putusan Mahkamah Agung No. 25 PK/Pid.Sus/2007, Putusan Mahkamah Agung No. 07 PK/Pid.Sus/2009, Putusan Mahkamah Agung No. 40 PK/Pid/2009, putusan Mahkamah Agung No. 16 PK/Pid.Sus/2007, Putusan Mahkamah Agung No. 153/Pid/2010, Putusan Mahkamah Agung No. 71 PK/ Pid.Sus/2009, Putusan Mahkamah Agung No. 38 PK/Pid.Sus/2011, Putusam Mahkamah Agung No. 84 PK/PJK/ 2010. Pertimbangan-pertimbangan hukum yang dikemukakan oleh dua (2) majelis pada Mahkamah Agung tersebut tentu membingungkan, yang mana harus diikuti karena tidak satu. Hal ini akan menimbulkan adanya ketidakpastian hukum. Ketiga, Terhadap kasus tersebut yang telah diputus oleh majelis Mahkamah Agung yang menerima dan mengakui Jaksa Penuntut Umum juga sebagai pihak yang dapat mengajukan peninjauan kembali menimbulkan perdebatan pro dan kontra dari kalangan pakar hukum. Perdebatan tersebut berlarut larut akibat multi tafsir dalam norma Pasal 263 ayat (1) KUHAP di kalangan penegak hukum. Oleh karena itu, perlu diatur lebih tegas pengaturannya dengan melalui kebijakan hukum pidana yang akan datang (ius constituendum). Kebijakan hukum pidana (di bidang hukum pidana formal) dapat dilakukan dengan cara melakukan pembaharuan hukum pidana (pembaharuan substansi hukum pidana formal). Pembaharuan hukum pidana (pembaharuan substansi hukum pidana formal), yaitu KUHAP dapat dilakukan dengan cara merevisi atau membuat Konsep KUHAP baru (RUU KUHAP). Dalam rangka pembaharuan hukum acara pidana (RUU KUHAP), Jaksa Penuntut Umum tidak perlu diberikan melakukan upaya hukum peninjauan kembali terhadap putusan pengadilan yang telah berkekuatan hukum tetap. Hal ini didasari oleh beberapa alasan, pertama, sebagai perbandingan dari negara-negara lain hanya negara China yang membolehkan Kejaksaan mengajukan peninjauan kembali. Kedua, Sejarah KUHAP untuk memberikan jaminan perlindungan terhadap hak asasi manusia. Maksud pembentukan lembaga peninjauan kembali semata-mata ditujukan bagi terpidana untuk meminta pemeriksaan ulang atas perkaranya, bukan untuk kepentingan negara. Munculnya atau mencuatnya persoalan lembaga peninjauan kembali dimulai sejak terjadinya kasus Sengkon dan Karta. Ketiga, KUHAP xii dibangun dengan filosofi perlindungan bagi pihak yang lemah dan rentan terhadap kekuasaan negara. Dibentuknya lembaga peninjauan kembali semata-mata ditujukan bagi kepentingan terpidana, bukan kepentingan negara atau korban karena substansi upaya hukum peninjauan kembali berpijak pada dasar bahwa negara telah salah mempidana penduduk yang tidak berdosa yang tidak dapat diperbaiki lagi dengan upaya hukum biasa. Keempat, menurut pandangan para praktisi hukum yang penulis wawancarai mengatakan bahwa Jaksa Penuntut Umu tidak perlu diberikan upaya hukum peninjauan kembali karena hak/kewenangan yang dimiliknya sudah cukup besar mulai dari pemeriksaan tingkat pertama (PN), banding (PT), dan kasasi (MA) untuk membuktikan kesalahan terdakwa. Oleh karena itu secara konseptual bahwa praktik Jaksa Penuntut Umum mengajukan permintaan peninjauan kembali terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap dalam perkara pidana merupakan penyimpangan dari hukum posistif (Pasal 263 ayat (1) KUHAP) dan tidak dapat dibenarkan karena norma Pasal 263 ayat (1) KUHAP secara tegas dan limitatif menetapkan terpidana atau ahli warisnya yang dapat mengajukan peninjauan kembali. Selain itu, dalam rangka pembaharuan hukum acara pidana (RUU KUHAP) Jaksa Penuntut Umum tidak perlu diberikan melakukan upaya hukum peninjauan kembali terhadap putusan pengadilan yang telah memperoleh kekuatan hukum tetap dalam perkara pidana. Dan sebagai saran adalah untuk mencegah ketidak pastian hukum dan sekaligus untuk menjaga asas keadilan dan untuk melindungi kepentingan masyarakat atau kepentingan umum, maka sebaiknya hak/kewenangan Jaksa Penuntut Umum untuk mengajukan permintaan peninjauan kembali perlu diatur secara tegas dan jelas dalam peraturan perundang-undangan. ...Current criminal law policy ( ius constitutum ) regulates the parties to submit a review of court decisions that have permanent legal force is convicted in a criminal case or their heirs as stipulated in the norms of Article 263 paragraph (1) Criminal Procedure Code. Article 263 paragraph (1) Criminal Code determines: "Against the decision of the court which has gained legal force, unless the judgment-free or free from all charges, convicts or their heirs can file a reconsideration request to the Supreme Court". However, it is in practice, the Supreme Court accept and acknowledge the Public Prosecutor as one party can file a reconsideration of court decisions that have permanent legal force except in cases pidan convicted or their heirs. It is found in some cases that have been decided by the Supreme Court, among others: the case of Muchtar Pakpahan are disconnected through a judicial review decision PK/Pid/1996 number 55, dated October 25, 1996, the case Gulumal alias Ram V. Ram also known as the case of The Gandhi Memorial School were terminated by reviewing PK/Pid/2001 number 3, dated August 2, 2001, the case Soetiyawati Ahua aka Binti Kartaningsih a cut through the reconsideration decision PK/Pid/2006 number 15, dated 19 June 2006, the case Pollycarpus Budihari Priyanto cut through PK/Pid/2007 decision number 109, dated January 25, 2008, which decided the case Syahril Sabirin through reconsideration decision PK/Pid.Sus/2009 number 07, dated June 8, 2009 and in the case of Joko Tjandra Soegiarto a cut through PK/Pid.Sus/2009 decision number 12, dated June 11, 2009. The issue of authority Prosecution did a review of court decisions that have permanent legal force in a criminal case must be confirmed arrangements to guarantee legal certainty in Indonesia by conducting criminal law policy for the coming (ius constituendum). The problems addressed in this study are as follows: first, whether the Public Prosecutor may be justified for reconsideration filed legal action in criminal cases. Second is how the application of remedies reconsideration by the Public Prosecutor in the practice of criminal justice in Indonesia. Third, how does the criminal law policy against authority Prosecutors? filed a judicial review in a criminal case. Furthermore, this study uses the method of normative juridical approach to legislation, the historical approach, the conceptual approach and the approach of the case. Legal source material used, the sources of primary and secondary legal materials getting techniques of data through library research and the study of laws and regulations. These results indicate that first, the problem of the Public Prosecutor filed a request reconsideration of court decisions that have permanent legal force in a criminal case is a departure from the positive law (Criminal Code) and cannot be justified because the norm of Article 263 paragraph (1) Criminal Procedure Code is the norm the obvious and limitatif regulate the parties to submit a review, the convicted person or their heirs. Besides that, the history and the establishment of institutions reconsideration solely intended for inmates to request a reexamination of the case. As an example is the case of Sengkon and Karta. Second, the application of remedies reconsideration by the Public Prosecutor in practice in Indonesia, the Supreme Court is inconsistent because on the one hand granted reconsideration by the Public Prosecutor and on the other hand refuse reconsideration of the case prosecutor, among other cases, such as H. Mulyar son Samsi of Muara Tuweh decided by the Supreme Court of Indonesia Number 84 PK/Pid/2006. The Supreme Court rejected the request a review of the Public Prosecutor on the grounds that Article 263 paragraph (1) Criminal Procedure Code has been set explicitly and limitatif should apply judicial review is convicted or heir (the reason the legislation), the Supreme Court Decision No.. 25 PK/Pid.Sus/2007, Supreme Court Decision No.. 07 PK/Pid.Sus/2009, Supreme Court Decision No.. 40 PK/Pid/2009, No. Supreme Court decision. 16 PK/Pid.Sus/2007, Supreme Court Decision No.. 153/Pid/2010, Supreme Court No.. 71 PK / Pid.Sus/2009, Supreme Court Decision No.. 38 PK/Pid.Sus/2011, Supreme Court No. Putusan. 84 PK / CHD / 2010. Legal considerations put forward by two (2) panel of the Supreme Court are certainly confusing, which should be followed because it is not one. This would lead to legal uncertainty. Third, respect the case that has been decided by the panel of the Supreme Court accepts and recognizes the Public Prosecutor as well as the parties may file reconsideration raises debate the pros and cons of the legal experts. The debate was protracted due to multiple interpretations within the norms of Article 263 paragraph (1) Criminal Procedure Code in the law enforcement. Therefore, it needs to be regulated more strictly by arrangement with the criminal law policy to come (ius constituendum). Criminal law policy (in the formal criminal law) can be done by means of criminal law reform (reform the substance of the formal criminal law). Renewal of the criminal law (criminal law reform formal substance), Criminal Procedure Code which can be done by revising or creating a new concept of the Criminal Procedure Code (draft Criminal Code). In order to reform criminal law (Criminal Code Bill), Public Prosecution need not be given to bring a legal review of the court decisions that have permanent legal force. It is based on several reasons, first, as a comparison of the other states that allow only Chinese state Attorney filed a reconsideration. Second, the history of the Criminal Procedure Code to ensure the protection of human rights. The purpose of the establishment of institutions reconsideration solely intended for inmates to request the re-examination of his case, not for the interests of the state. Therefore, conceptually the practice of the Prosecution filed a request reconsideration of court decisions that have permanent legal force in a criminal case is a positive deviation from the law (Article 263 paragraph (1) Criminal Code) and cannot be justified because the norm of Article 263 paragraph (1) xv Criminal Procedure Code expressly and limitatif assign inmates or their heirs can submit a review. In addition, in order to reform criminal law (Criminal Code Bill) Prosecutors need not be given to bring a legal review of the court decisions that have permanent legal force in the criminal case. And the advice is to avoid legal uncertainty and also to maintain the principles of justice and to protect the public interest or the public interest, it should be the right / authority of the Public Prosecutor to file a reconsideration request needs to be explicitly and clearly in the legislation.en_US
