Perlindungan Hukum Terhadap Konsumen Atas Kenaikan Harga Obat Covid-19 Akibat Penimbunan
Abstract
The purpose of this study is to determine the form of legal protection for consumers for the increase in the
price of Covid-due to hoarding and the form of accountability for business actors who hoard Covid-. This
study uses a normative legal research method, with astatute approachand a conceptualapproach, with
legal materials consisting of primary, secondary, and non-legal materials. The results of the study show
that first, legal protection is carried out in the form of external legal protection. This external legal
protection is deemed more appropriate given the position of consumers who are weaker than other parties,
so that the government issues a rule in the form of legislation in order to protect the rights of consumers,
and to create a healthy and conducive business climate. Second, the form of accountability for business
actors who hoard Covid-19 drugs is through a lawsuit against the law (PMH) where several possible
types of prosecution are given. The compensation here is not always in the form of money because the
return to its original state (inkind) is the most appropriate compensation payment.
