Pelanggaran Hak Cipta Film yang Diunggah Tanpa Izin pada Aplikasi TikTok

Abstract

Copyright is the exclusive right of the owner that automatically given based on declarative principles after the creation is manifested in a tangible form without limitation in accordance with the provisions of the act. The exclusivity includes Moral Rights and Economic Rights. One type of work that is protected by copyright is cinematographic works, including movie. Even though it has been protected, movie copyright infringement still occurs, especially in a music video application named TikTok. Many users of the TikTok app uploading various types of movie that are divided into sections of video content with varying durations, which are between 15 seconds to 3 minutes. This study aims to find any copyright infringement on the upload of movie on the TikTok application, find the legal protection that can be given to Copyright holders or Related Rights Owners and dispute settlements that can be done if there is a copyright dispute for films uploaded on TikTok. This study uses a normative juridical method and concludes that uploading films without permission on the TikTok application is a copyright infringement due to a violation of Economic Rights and Moral Rights that regulated on Law Republic of Indonesia No 28 of 2014 on Copyright, the legal protection provided can be in two forms, namely external and internal, as well as settlements that can be carried out through litigation. and non-litigation.
